Terms of Service

1. Agreement to these Terms
These Terms of Service ("Terms") govern your access to and use of FindMyHelp.com.au (the "Platform"), operated by Aware Labs Pty Ltd (ABN 41670991401) ("we", "us", "our"), trading as FindMyHelp.
By accessing or using the Platform — whether as a care seeker, family member, representative, or provider — you agree to be bound by these Terms. If you do not agree, you must not use the Platform.
2. What FindMyHelp Does (and Does Not Do)
FindMyHelp is a connection and matching platform only. We help people looking for NDIS and aged care support ("Seekers") submit requests, and we notify relevant registered providers ("Providers") who may be able to assist. We facilitate introductions by sharing request details with matched Providers via email and/or SMS.
We do not provide care, support, or clinical services. We are not an NDIS registered provider, aged care provider, support coordinator, plan manager, or employment agency. We do not employ, supervise, vet, endorse, recommend, or guarantee any Provider. We do not negotiate, arrange, or manage care agreements on your behalf.
Any relationship formed after an introduction — including assessment, service agreements, pricing, quality of care, and compliance with applicable laws — is solely between the Seeker (or their representative) and the Provider. We are not a party to those arrangements.
3. Eligibility
You must be at least 18 years old to use the Platform. If you submit a request on behalf of another person, you confirm that you have authority to do so and to share their information as described in our Privacy Policy.
Providers must be legally able to enter contracts and must hold all licences, registrations, and approvals required to deliver the services they offer.
4. For Care Seekers
When you submit a request through the Platform, you acknowledge and agree that:
- You are responsible for the accuracy and completeness of the information you provide, including contact details, location, service needs, and funding type.
- We will share relevant request details with matched Providers so they can contact you directly. You consent to this disclosure when you submit a request.
- We do not guarantee that any Provider will respond, that you will receive a minimum number of responses, or that any Provider will be suitable for your needs.
- You are solely responsible for evaluating Providers, verifying their credentials, registrations, insurance, and suitability before engaging them. You should conduct your own due diligence, including checking NDIS registration status where applicable.
- We do not provide medical, legal, financial, or care planning advice. Information on the Platform is general in nature and not a substitute for professional advice.
5. For Providers
When you claim a listing, create an account, or receive matched requests, you acknowledge and agree that:
- You are solely responsible for the accuracy of your listing, your communications with Seekers, and your compliance with all applicable laws, including NDIS Practice Standards, aged care requirements, privacy laws, and workplace laws.
- Receiving a matched request does not constitute an endorsement, referral, or guarantee of work from us.
- You will respond to Seekers promptly and professionally, and you will not use contact details obtained through the Platform for unrelated marketing without appropriate consent.
- Listing information may be sourced from public registers and third-party data. You should review and update your profile after claiming a listing.
6. Premium Subscriptions
Providers may subscribe to premium features (such as priority matching or additional notification channels) through our payment processor, Stripe. Subscription fees, billing cycles, and cancellation terms are presented at the point of purchase. Premium features affect how and when you may be notified of requests; they do not guarantee a minimum volume of leads or engagements.
Fees are non-refundable except where required by the Australian Consumer Law or expressly stated otherwise at purchase.
7. Provider Listings and Reviews
Provider profiles may include information from public NDIS registers, our data pipelines, and information submitted by Providers. We do not warrant that listing information is complete, current, or error-free.
Reviews submitted by Seekers reflect individual experiences and opinions. We do not verify review content and reviews do not constitute our endorsement of any Provider.
8. Acceptable Use
You must not:
- Use the Platform for unlawful, misleading, or fraudulent purposes.
- Submit false, defamatory, or harmful content.
- Attempt to access accounts, data, or systems without authorisation.
- Scrape, harvest, or systematically collect data from the Platform without our written consent.
- Interfere with the operation or security of the Platform.
We may suspend or terminate access if we reasonably believe you have breached these Terms or pose a risk to other users or the Platform.
9. Intellectual Property
The Platform, including its design, software, branding, and content (excluding user-submitted and third-party content), is owned by or licensed to us. You may not copy, modify, distribute, or create derivative works without our prior written consent.
You grant us a non-exclusive, royalty-free licence to use content you submit (such as reviews, profile updates, and request details) to operate and improve the Platform.
10. Privacy
Our collection and use of personal information is described in our Privacy Policy, which forms part of these Terms.
11. Third-Party Services
The Platform integrates with third-party services including Firebase (authentication), Stripe (payments), email and SMS delivery providers, and analytics tools. Your use of those services may be subject to their own terms and privacy policies. We are not responsible for third-party services outside our reasonable control.
12. Disclaimers
To the maximum extent permitted by law, the Platform is provided on an "as is" and "as available" basis. We make no representations or warranties — express or implied — regarding:
- The availability, reliability, or uninterrupted operation of the Platform.
- The accuracy, completeness, or currency of Provider listings or other content.
- The suitability, quality, safety, legality, or conduct of any Provider or Seeker.
- The outcome of any introduction, match, or engagement between users.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot be excluded under the Australian Consumer Law.
13. Limitation of Liability
To the maximum extent permitted by law, we are not liable for any loss, damage, cost, or expense arising from or connected with your use of the Platform or any introduction, match, or interaction between users — including care or support services provided (or not provided) by a Provider.
This includes, without limitation, liability for:
- Personal injury, illness, death, or property damage.
- Financial loss, lost revenue, or loss of opportunity.
- Negligence, breach of contract, or misrepresentation by any Provider or Seeker.
- Reliance on information on the Platform.
- Failure to match, delayed notification, or Provider non-response.
Where liability cannot be excluded, our total aggregate liability to you for any claim arising from or related to the Platform is limited to the greater of (a) AUD $100 or (b) the total fees you paid us in the 12 months before the claim arose.
These limitations apply whether liability arises in contract, tort (including negligence), statute, or otherwise, even if we have been advised of the possibility of such loss.
14. Indemnity
You agree to indemnify and hold harmless Aware Labs Pty Ltd, its directors, officers, employees, and contractors from and against any claim, loss, damage, liability, cost, or expense (including reasonable legal fees) arising from:
- Your use of the Platform or breach of these Terms.
- Content or information you submit.
- Your interactions with other users, including care or support services you provide or receive.
- Your violation of any law or third-party rights.
15. Termination
You may stop using the Platform at any time. We may suspend or terminate your access with or without notice if we reasonably believe you have breached these Terms or if continued access would harm the Platform or other users.
Sections that by their nature should survive termination (including disclaimers, limitation of liability, indemnity, and governing law) continue to apply.
16. Changes to these Terms
We may update these Terms from time to time. The effective date at the top of this page will be revised when changes take effect. Material changes will be posted on the Platform. Continued use after changes constitutes acceptance of the updated Terms.
17. Governing Law and Disputes
These Terms are governed by the laws of New South Wales, Australia, Australia. You submit to the non-exclusive jurisdiction of the courts of that state and the Commonwealth of Australia.
Before commencing legal proceedings, you agree to contact us at sam@findmyhelp.com.au and attempt to resolve the dispute in good faith.
